The Business Reorganization Committee had a busy and successful 2023, and we are already looking forward to another great year in 2024.
Over the past year, committee members took advantage of the many benefits afforded them, including the committee’s newsletters and educational programs, and have taken part in active discussions over the listserv regarding hot topics and industry trends. We have big plans for 2024, and we thank our committee members and leadership for their support and continued participation.
We are excited to continue growing and providing relevant and interesting content for our members. The committee always welcomes any ideas for newsletter contributions, webinar topics, seminar panels, podcasts and other special projects. Below are a few highlights from the committee’s activities over the last year.
Educational Programming and Special Projects
Our committee was thrilled to present in-person panels at the 2023 Annual Spring Meeting in Washington, D.C., and the 2023 Winter Leadership Conference in Scottsdale, Ariz. At the Spring Meeting, we teamed up with the Emerging Industries and Technology and Unsecured Trade Creditors Committees to host “Issues Impacting Unsecured Creditors in Crypto Bankruptcies.” At the Winter Leadership Conference, we paired with the Young and New Members Committee to present “The Intersection of Arbitration and Bankruptcy.” Both panels were a great success, with esteemed and insightful speakers and tremendous audience engagement.
The Business Reorganization Committee also hosted a webinar in September 2023, “Current Topics in Health Care Restructurings.” The panel discussed emerging threats from recent restructurings and bankruptcies in the health care industry, with a special focus on hospitals and biotechnology companies.
Our committee was particularly excited to host an episode for an ABI podcast this year, recorded in November 2023. The episode will be part of a running series the committee will be recording, called “Unordinary Course.” The series will feature experts discussing current events and emerging market trends.

Newsletter
With contributions from our committee members, in 2023 we published two newsletters (including this one) with five articles. These articles covered cryptocurrency bankruptcy cases, updates on the J. Alix Protocol, and the solvent-debtor exception to post-petition interest, and we thank all our contributors for their helpful and thought-provoking submissions. The newsletters with these articles can be found on the Business Reorganization Committee’s web page.
We are always looking for articles that provide up-to-date analyses of emerging hot topics in the restructuring world, and we welcome your submissions. Many of our members have enjoyed the profile-raising benefits of publishing in our widely distributed newsletter. If you are interested in writing an article or have any ideas or suggestions, please contact our co-chairs or Newsletter Editor Colleen Restel.
Listserv
Moving into 2024, we plan for the listserv to continue providing a meaningful opportunity to foster discussion and a means for promoting ABI-related business and events. The listserv is the perfect place to, among other things:
- discuss recent court opinions;
- debate topical areas of particular interest;
- discuss important/interesting bankruptcy and restructuring news and developments;
- solicit input regarding practice and procedure; and
- publicize ABI-related business, including upcoming programs and newsletters.

Social Events
With the Young and New Members Committee, we hosted a pre-Opening Reception happy hour at the 2023 Annual Spring Meeting. The event was enjoyed by all who attended, and committee members had a great time meeting in person, networking and catching up. Planning for 2024
The Business Reorganization Committee is already at work planning for 2024. We hope that you will join us for more educational programming and social/networking activities.
Over the course of the coming year, we will continue to identify ways for committee members to get involved. Newsletter articles and webinars are a great way to do so, as well as the listserv and ABI podcasts. Please share with us any other ideas, questions or thoughts that you may have regarding the Business Reorganization Committee or ABI in general. Our goal is to make membership in the Business Reorganization Committee valuable and rewarding, and we always welcome ideas for how to improve that experience.
