Hello and thank you to our existing members, and a warm welcome to those recently joining us. We hope this newsletter finds you well, and we look forward to seeing all of you in the coming year.
Recent Events
The committee partnered with the Real Estate Committee for ABI’s 2023 Annual Spring Meeting in April to discuss what happens when lenders default on paying borrowers for non-monetary reasons, and the impact and efficacy of this strategy. Two members of our very own leadership team, Jane Kim and William Hao, participated in what was a very lively and entertaining session with fellow panelists Prof. Andrea Coles-Bjerre and Robert LeHane.
At the conclusion of the panel, the committee announced the winners of the Fifth Annual Asset Sale of the Year Award: Electric Last Mile Solutions Inc.; LaForta Gestao E Investmentos Sociedade Unipessoal LDA; and Haven Campus Communities – Starkville, LLC. Each of the award recipients is featured in this issue of the committee newsletter, where you can read more about these award-winning deals. Stay tuned for details and deadlines to nominate for this year’s award.
The committee co-hosted a panel with the Unsecured Trade Creditors Committee at the Winter Leadership Conference in Scottsdale, Ariz., titled The Brave New World of Asset Sales and the Increased Role of Unsecured Creditors. Our fantastic panelists include Richelle Kalnit (Hilco Global; New York), Melissa Kibler (Accordion Partners; Chicago), Nick Rubin (Force 10 Partners; Irvine, Calif.), and Mark Salzberg (Squire Patton Boggs; Washington, D.C.). This panel took a fresh look at the latest categories and buyers of asset sales under § 363, and the increased influence that unsecured creditors are exerting over those sales.
We also are excited to announce that we will be partnering with the Health Care Committee at ABI's Annual Spring Meeting in 2024. Information on that panel is forthcoming, so stay tuned!
Upcoming Events
The committee is planning to host a webinar in Q1 of 2024 and welcomes input from our members regarding potential topics. Please reach out to William Hao if you are interested in participating or to suggest a topic you would like to see covered.
The committee also intends to return to its release of quarterly newsletters in 2024. If you wish to contribute by writing about interesting or developing asset sales issues, please contact Jane Kim.
