Comparative Analysis of Centralized vs. Decentralized Cross-Border Proceedings
This panel presents a comparison of the differences between centralized cross-border proceedings, where there is a main proceeding with related ancillary proceedings in other countries that are controlled by the same management and professionals (e.g., the recent airline cases of LATAM, Avianca and Philippine), and decentralized cross-border proceedings, where related entities in different jurisdictions have independent proceedings run by separate management and professionals (e.g., Greensill Capital). The panelists also discuss factors that could lead to a centralized vs. decentralized cross-border proceeding, and the different challenges each one presents.
