Out-of-the-Ordinary Out-of-Court Restructuring Issues

This panel discusses a potpourri of unique and interesting issues that present themselves in various out-of-court restructuring contexts. Topics to be covered will include corporate finance transactions such as tender offers or exchange offers (including coercive exchange offers); convertible debt; PPP funding challenges and impacts; managing confidentiality/NDA issues; dealing with ad hoc committees and crossover committees; restructuring support agreements/death-trap provisions; and strategies for garnering creditors’ support for a restructuring when no formal or informal committee structure is present for creditors.
