ABI's Views from the Bench Program to Examine Systematic and Existential "Threats" to the Bankruptcy System on October 7 at Georgetown University Law Center

Alexandria, Va. ABI’s popular “Bankruptcy 2016: Views from the Bench” program will take place on Oct. 7 at The Georgetown University Law Center in Washington, D.C. The program features the views of 18 bankruptcy judges from New York, New Jersey, Delaware, Maryland, Virginia, Pennsylvania, Florida, Texas and Nevada. This year's conference examines the systematic and existential “threats” to the historical way the bankruptcy system has functioned, including structured dismissals, equitable mootness, gifting, successor liability, RSAs, and costs and legal fees. Attendees have the chance to earn up to 6 hours of CLE credit. The chair of the “Views from the Bench” program is David R. Kuney of Whiteford Taylor Preston, LLP (Washington, D.C.)

 

Two great debates will be the centerpiece of the program. Craig Goldblatt of WilmerHale (Washington, D.C.) will debate Bankruptcy Judge Kevin J. Carey (D. Del., Wilmington) over the use of structured dismissals, especially where the settlement is not consistent with the absolute priority rule. Retired Bankruptcy Judge Robert E. Gerber will also debate William Weintraub of Goodwin Procter (New York) on whether asset sales under § 363 should lawfully be free and clear of successor-liability claims. This issue was recently the focus of a decision by the U.S. Court of Appeals for the Second Circuit.
