3RD ANNUAL NORTHEAST CONSUMER WINTER FORUM TO EXAMINE THE MORTGAGE
DOCUMENTATION AND FORECLOSURE CRISES, CURRENT DEVELOPMENTS IN CHAPTER 7
AND 13 CASES AND CONSUMER ISSUES IN THE NEW CONGRESS

 The American Bankruptcy Institute (ABI)

brings its 2011 Northeast Consumer Winter Forum to Suffolk University
Law School in Boston on January 17, 2011, for a day-long educational
conference devoted to the consumer bankruptcy professional. The program
will consist of panel discussions led by experts on current issues in
consumer bankruptcy cases, and a litigation skills forum featuring
advice from bankruptcy judges and litigators. In addition, attendees are

invited to join ABI Executive Director Samuel J. Gerdano for a
lunchtime discussion on consumer bankruptcy issues in the new Congress.
Approval for up to 5.5 hours is pending.

Conference co-chairs for the
Forum include Anne J. White of Demeo & Associates, P.C.
(Boston) and Jenny Yandell of Parker & Associates
(Winchester, Mass.). Bankruptcy Judge Joan N. Feeney (D. Mass.;
Boston) is the judicial chair of the program.

Panel sessions at the Consumer
Winter Forum include:

  • Today’s Chapter 13: Most

    recent case law regarding “proposed disposable income” and
    latest issues concerning feasible chapter 13 plans


  • Today’s Chapter 7:
    Recent developments, including exemption issues, trust issues, asset
    disclosure—what does the trustee want, and how does debtor’s

    counsel respond?


  • U.S. Trustee’s Office
    Perspective: Recent Developments
    featuring William K. Harrington, Office of the U.S. Trustee,
    Region 1; Boston

  • Mortgage Documentation
    Mess

  • Foreclosure Resistance: How to

    discover facts to establish or defend against mortgage
    authenticity

The Forum will also feature an
afternoon panel providing mock presentations on gathering evidence
related to mortgage-documentation issues. The panel will focus on such
skills as authentication, business records exception to the hearsay

rule, non-hearsay admissions, impeachment of a witness by prior
inconsistent statements in a deposition, procedures for refreshing
recollection as opposed to introduction of past recollection recorded,
introduction of appraisal evidence, testimony, and reports, charts and
summaries.
