TV Streaming Service Aereo Files for Bankruptcy

Television streaming service Aereo Inc. filed for bankruptcy protection after a U.S. Supreme Court ruled in June that the company's business model violated copyright laws, Reuters reported today. InterActiveCorp has a 23.30 percent stake, said in a chapter 11 filing yesterday said that it would sell its assets or reorganize. The Court in June said that Aereo had infringed copyrights of broadcasters by capturing live and recorded programs through antennas and transmitting them to subscribers for $8-$12 a month. Aereo, which raised $95.6 million in financing, suspended its streaming service at the end of June and cut jobs. The company listed total assets of $20.5 million and debt of about $4.2 million in its filing. The filing is In re Aereo Inc., U.S. Bankruptcy Court, Southern District of New York, No:14-13200.

Hutcheson Medical Centers Board Votes to File for Chapter 11

Hutcheson Medical Center’s board of directors voted Wednesday night to file for chapter 11 protection, the Chattanooga Times Free Press reported today. Hutcheson has been unable to repay $20 million it borrowed from Erlanger Health System and is facing a threat of foreclosure. In January, Erlanger filed a civil lawsuit against Hutcheson, who was supposed to pay back the $20.5 million loan by Dec. 1 of last year.

Regional Recycling Firm Files for Bankruptcy in Memphis

One of the largest recycling companies in the Southeast, Memphis-based Recycle Solutions Inc., has filed for chapter 11 protection, the Memphis Business Journal reported today. Recycle Solutions, launched in 2001, reported debts of nearly $6.4 million and assets of more than $11.5 million in its voluntary petition filed on Nov. 4 in U.S. Bankruptcy Court. The filing comes after the company, hard hit by the recession, faces a $300,000 civil penalty by the Arkansas Department of Environmental Quality. On top of that, the company has a claim for an "unknown" amount against the town of Villa Rica, Georgia, where a dispute with the town has halted its operations.

Baxano Surgical files for Chapter 11

Raleigh, N.C.-based surgical device developer Baxano Surgical filed for chapter 11 protection and will sell its product lines through a court-supervised auction process, the Triangle Business Journal reported today. Founded in 2000, Baxano designs and markets minimally invasive products to treat degenerative conditions of the spine affecting the lumbar region. Any sale of Baxano Surgical's products in connection with the bankruptcy case will be subject to bankruptcy court approval, and could be subject to antitrust approval.

OW Bunker Files U.S. Bankruptcy Days After Fraud Report

Three U.S. units of OW Bunker A/S, the Danish shipping-fuel supplier that went from a $1 billion valuation after its initial public offering in March to bankruptcy last week, sought creditor protection in Connecticut, Bloomberg News reported today. The subsidiaries filed chapter 11 petitions yesterday in U.S. Bankruptcy Court in Bridgeport, Conn., listing assets of as much as $50 million against debt of as much as $100 million. The parent filed for bankruptcy on Nov. 7 in Denmark, blaming a $125 million internal fraud and risk management failures. OW Bunker, which eight months ago had Denmark’s second-biggest IPO since 2010, stunned investors after saying it would report to police two senior executives at its Singapore unit for alleged fraud. The Noerresundby-based company said it lost another $150 million on bad risk management.

Renault Winery Files for Bankruptcy Protection

Renault Winery Resort and Golf, the sprawling vineyard-golf resort-restaurant that straddles Egg Harbor City and Galloway Township, N.J., filed for chapter 11 protection yesterday, the Press of Atlantic City reported. Chief Operating Officer Dennis Del Vecchio said that the resort will remain open while it finds a stable financial footing in bankruptcy. The resort had been scheduled by Renault’s main creditor and mortgagee, OceanFirst Bank, for a sheriff’s sale auction in October that was adjourned until yesterday. The sale was canceled on account of the bankruptcy. Early this year the resort’s management said a New Jersey-based buyer had been found for the property, which was expanded under owner Joseph Milza, who bought the winery in 1977.
The 50-room Tuscany House hotel was added in 2001 and the 18-hole Vineyard Golf course in 2004.

Dendreon Files for Bankruptcy as Cancer Drug Disappoints

Dendreon Corp., the maker of prostate-cancer drug Provenge, filed for bankruptcy protection, potentially wiping out shareholders in a company that pioneered the use of patients’ immune systems to fight tumors, Bloomberg News reported yesterday. The agreement calls for a recapitalization of Dendreon, or a sale of the company or its assets, the Seattle-based drugmaker said yesterday. The company and its U.S. subsidiaries filed chapter 11 petitions in U.S. Bankruptcy Court in Delaware. Provenge, approved in 2010 as the first so-called immunotherapy, was designed to treat patients with advanced-stage prostate cancer, the second-leading cause of cancer deaths among men in the U.S. The drug never lived up to expectations because it’s cumbersome to administer and costs $93,000. Dendreon said that it plans to continue operations during the restructuring and will provide Provenge to patients. The company has about 700 employees in Seattle and Bridgewater, N.J., after cutting about 750 full-time and contractor positions in 2012 and 2013 and selling a New Jersey plant.

UniTek Files Bankruptcy with Plan to Give Lenders Control

UniTek Global Services Inc., a contractor for telecommunication companies, filed for bankruptcy with a plan to hand control over to its lenders, Bloomberg News reported yesterday. The Blue Bell, Pa.-based company listed assets of $3.2 million and debt of $186 million in chapter 11 documents filed yesterday. The company announced last month that it had reached an agreement on terms of a restructuring with lenders including affiliates of Littlejohn & Co. and New Mountain Capital. The company will ask to borrow as much as $43 million in debtor-in-possession financing. Apollo Investment Corp. is the administrative agent. The case is In re UniTek Global Services Inc., 14-12471, U.S. Bankruptcy Court, District of Delaware (Wilmington).

Clark Appliance Files for Chapter 11

Clark Appliance, a high-end home appliance retailer in business for more than 100 years, filed an emergency voluntary petition for chapter 11 relief on Friday, the Indianapolis Star reported yesterday. In a letter to customers, owner Bob Clark said that the move was motivated by a number of financial problems that have plagued the company since 2008. Court documents state that Clark Appliance owes about $2.2 million to its largest single creditor, General Electric. First Business Capital Corp., an asset-based lender in Madison, Wis., is owed about $2 million.

Mississippi Fertilizer Company Files for Chapter 11

Fertilizer company Mississippi Phosphates Corp. filed for chapter 11 protection on Monday with plans to remain open but eventually sell its assets, Dow Jones Daily Bankruptcy Review reported today. Mississippi Phosphates said in its court filing that it has between $100 million and $500 million in both assets and liabilities. The company said in a separate filing that it plans to file motions establishing a "formal sales process" within a week. Mississippi Phosphates blamed its bankruptcy filing on several things, including natural disasters, unplanned shutdown of its production plants and "unsuccessful planned turnarounds."
